Official Rules

No purchase or payment is necessary to enter or win. A purchase will not increase your chances of winning. Void where prohibited by law, rule, or regulation.

The giveaway consists of one (1) prize drawing total and is offered only to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age and over on the date of entry. The giveaway has one Entry Period, as outlined below. Employees, officers, and directors of Delta Dental of North Carolina (“Delta Dental”), and its affiliates and subsidiaries, their immediate families, and those living in their households are not eligible to participate. One entry per person.

Eligible individuals may enter the giveaway by following Delta Dental of North Carolina on Facebook or Instagram, “liking” the giveaway post, and tagging another person in a comment on the giveaway post during the Entry Period. Eligible individuals also may enter the sweepstakes by submitting their name and email address to Delta Dental at nbaez@deltadentalnc.com during the Entry Period.

The giveaway consists of one (1) Entry Period as follows:

Prize Winners Selected: One (1)

Winners will be selected in a random drawing according to the prize drawing schedule above from among all eligible entries received during the Entry Period. Odds of winning depend solely upon the number of eligible entries received.

The winner will be notified via e-mail, and may be congratulated publicly on Delta Dental’s Facebook page or other social media platforms thereafter. The winner must comply with all instructions in the prize notification message, including completion of any documentation provided by Sponsor, and return within seventy-two (72) hours from the time of notification, and also must meet all of the eligibility requirements set forth within these rules, except where prohibited by law. If these requirements are not met, the prize will be forfeited and an alternate winner will be selected.

Acceptance or use of a prize constitutes permission for Delta Dental and its affiliates, subsidiaries and designees to use and/or publish a winner’s name (in whole or in part), social media handle, city and state of residence. Photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), and /or statements made by winner regarding the Giveaway or Sponsor, worldwide and in perpetutity for any and all purposes, including, but not limited to advertising, trade and/or promotional purposes in any and all forms of media, now known or hereafter devised, including, but not limited to print, TV, radio, electronic, cable, World Wide Web, without compensation, notice, review or approval unless otherwise prohibited by law.

One verified winner who meets all requirements will receive one Z Sonic electric toothbrush, valued at $50.00, and one Amazon gift card valued at $50 sent via mail to the address provided to Delta Dental.

All entries must be personally entered by the individual who is listed as the entrant and no third parties may enter the giveaway for or on behalf of any person. Any dispute regarding submission of any online entry will be deemed submitted by the authorized account holder of the social media account or email address used to submit the entry. The “authorized account holder” is deemed to be the natural person who is assigned to an email address or social media account by an Internet access provider, service provider or other online organization that is responsible for assigning email addresses or social media accounts for the relevant service. A potential winner may be requested to provide Delta Dental with proof that the potential winner is the authorized account holder of the email address or social media account provided at the time of entry.

Delta Dental is not responsible for lost or misdirected mail or email, or for any malfunction, failure to function, or additional costs associated with use of the prize. Return of any prize or prize notification as undeliverable will result in disqualification and selection of an alternate winner. Only one (1) prize will be awarded.

By participating in this giveaway, participants agree to release, discharge and hold harmless Facebook, Instagram, Z Sonic, Amazon, and Delta Dental, and their respective parents, affiliates, subsidiaries, representatives, agents, officers, directors and employees, successors and assigns, (the “Released Parties”) from any and all liability, loss, harm, injury (including emotional distress), death, and/or damages which may arise out of participation in the promotion or out of the acceptance, use, misuse, or possession of a prize or participating in any giveaway-related or prize-related activity and for any claims or causes of action based on publicity rights, defamation or invasion of privacy and merchandise delivery. The Released Parties assume no responsibility for any injury or damage to entrants or to any other person's computer, regardless of how caused, relating to or resulting from entering or downloading materials or software in connection with this Giveaway. Entrants and winner acknowledge that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representations or guarantees, express or implied, in fact or in law, relative to any prize or any component thereof. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant or Sponsor in connection w ith the Giveaway, shall be resolved individually, without resort to any form of class action. Any and all claims, judgment and awards shall be limited to actual outofpocket costs incurred, but in no event attorneys' fees, and under no circumstances will entrant be permitted to obtain awar ds for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual outofrights to have damages multiplied or otherwi pocket expenses, and further waives any and all se increased. Liability for any applicable taxes, including all federal, state and local taxes and/or other fees or expenses that may apply to prizes are the sole responsibility of the winner.

If for any reason the Internet portion of the giveaway is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Delta Dental that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, Delta Dental reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend the giveaway. Delta Dental assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications-line failure, theft, or destruction or unauthorized access to, or alteration of, entries. Delta Dental is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, or software, or for failure of any entry to be received by Delta Dental on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this giveaway. CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEB SITE (INCLUDING BUT NOT LIMITED TO FACEBOOK) OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, DELTA DENTAL RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.

Delta Dental reserves the right to suspend or cancel the giveaway or modify these official rules as necessary for any reason or as required by applicable law.
